Wittig resentencing scheduled for April

A federal judge has scheduled resentencing for former Westar Energy Inc. Chief Executive David Wittig and an ex-bank president for April 24.

The 10th U.S. Circuit Court of Appeals last week threw out the sentences that U.S. District Judge Julie Robinson imposed on Wittig and former Capital City Bank President Clinton Odell Weidner II, after the two men were convicted in July 2003 of hiding a $1.5 million loan from bank officials and federal regulators.

While the appeals court said Robinson had erred in determining the amount of loss incurred in the crime, it upheld the convictions.

Wittig was sentenced to more than four years in prison for conspiracy, bank fraud and money laundering. He had been free pending appeal until January, when Robinson sent him to prison for violating the terms of his release.

Weidner, who pleaded guilty to two of six counts before jurors convicted him of the rest, was sentenced to 6 1/2 years in prison and began serving his sentence in April 2004.
