Alumni Association documents sealed

The ousted director of the Kansas University Alumni Association says it was a mistake that a 25-page report detailing his feud with the group wound up in a public court file.

On Tuesday, at the request of former Alumni Association director Fred Williams, Judge Michael Malone ordered the report removed from the public court file.

Malone’s order was filed the same day that details of the dispute were published for the first time in a Journal-World article. Williams’ attorneys say they attached the report to a court motion last week “through inadvertence.”

Williams was fired in 2004 after more than 20 years at the head of the Alumni Association. He later sued for more than $2 million, alleging breach of contract and defamation.

Williams wanted his lawsuit handled in open court, but the Alumni Association argued it should be resolved behind closed doors by an arbitration panel. Malone agreed.

Earlier this year, a three-member arbitration panel found unanimously against Williams, in part because his contract didn’t guarantee him any due process rights before being fired.

Last week, Williams filed a motion in District Court asking the judge to vacate the panel’s findings, alleging there was “no valid arbitration agreement” between himself and the Alumni Association in the first place.

He attached a copy of the arbitration panel’s report, which he now says was supposed to have stayed confidential.

Attorneys for both sides did not return phone calls Tuesday seeking comment.
