Topeka ? A man accused of killing a passenger when he lost control of the truck he was driving was convicted of involuntary manslaughter under the influence of alcohol.

Glenn R. Triebwasser, 59, of Topeka, also was convicted Wednesday of driving on a suspended license, failure to maintain a single lane and a seat belt infraction stemming from the April 2005 rollover that killed Billie Jo Baldwin, 40, of Meriden.

Triebwasser testified that Baldwin, who was thrown from the vehicle, was driving the truck when it tumbled out of control on Interstate 70. Triebwasser maintained he was the passenger.

But strands of hair proved Triebwasser was in the driver’s seat, a Kansas Highway Patrol investigator told jurors earlier in the trial.

Judge Thomas Conklin rejected a late motion by defense attorney Jerry Berger calling for a mistrial, citing prejudicial remarks against Triebwasser.

Sentencing was scheduled for Sept. 15
