A Lawrence man entered a plea to a misdemeanor Monday after having a previous conviction in the same case thrown out based on a finding that his defense attorney — newly elected Dist. Atty. Charles Branson — was ineffective.

Timothy L. Turner entered a plea to misdemeanor obstruction and was allowed to go free. Turner, who was originally convicted of aggravated assault against the mother of his children, already has served about 10 months in prison, a prosecutor said.

Turner now faces another charge of domestic battery from an incident that happened Feb. 22 after he was released from prison.

Judge Jack Murphy found Branson didn’t fully investigate Turner’s criminal-history score, which caused Turner to enter a plea thinking he would get probation instead of prison.
