Court sets date for abortion arguments

? The state’s highest court has scheduled arguments from attorneys for Sept. 8 on whether it should prevent Atty. Gen. Phill Kline’s office from gaining access to records from two abortion clinics.

The court announced its plans Friday in a one-paragraph notice signed by Chief Justice Kay McFarland.

Last year, at Kline’s request, a Shawnee County judge issued subpoenas for the records of 90 patients from Dr. George Tiller’s clinic in Wichita and the Overland Park clinic operated by Planned Parenthood of Kansas and Mid-Missouri.

The clinics then asked the Supreme Court to block the subpoenas.

Both clinics contend Kline, a vocal opponent of abortion, is on a fishing expedition. They also argue that turning over the records will lead to violations of patients’ privacy.

Kline has said repeatedly that he needs the records as part of an investigation into child rape and potentially illegal late-term abortions. He has the support of local prosecutors.
