Judge clears transsexual of charges

? A transsexual accused of filing a false marriage license application was cleared today by a Leavenworth County district court judge.

After testimony from experts Monday and Tuesday, Judge Frederick Stewart ruled there were not grounds for the charge against 49-year-old Sandy Gast.

The judge said Gast, who considered herself a woman even before sex change surgery, had not intentionally falsified the application form.

Gast had hoped to marry fellow transsexual Georgi Somers.

The Kansas Supreme Court in 2001 ruled that a person’s sex is determined at birth and is not subject to change, no matter what happens in surgery.
