Moldy home court case brings $1 million judgment

? A Sedgwick County jury has awarded more than $1 million in damages to a Wichita couple who claimed they bought a house infested with mold.

The jury said in its verdict that Ron and Linda Tyler, who built the house in the mid-1980s, were negligent in failing to mention chronic roof problems when they sold the home to Bill and Jeanine Phillips for $950,000 in 1998.

The Phillipses contended in their lawsuit that it would cost more than $1 million to repair the home.

“Obviously we’re thrilled — No. 1 to have this behind us, and No. 2 to get a favorable verdict from the jury,” Bill Phillips said Thursday after the verdict was announced.

The Phillipses argued the mold could be traced to a leaky tile roof and the problem should have been mentioned in the Tylers’ disclosure statement.

The sellers contended that the roof was sound when the sale occurred.

The family moved out of the home after Jeanine Phillips and her 17-year-old son started experiencing chronic health problems.
