Judge considering ticket suit

A legal spat over a Kansas University athletic department decision last year to make nondonors pay $5,000 to hold on to their men’s basketball season tickets isn’t over.

Douglas County District Judge Jack Murphy on Friday listened to arguments for and against dismissing the lawsuit.

“I’ll take this under advisement,” Murphy said. He is expected to issue a decision within a month.

Brock Snyder, a Topeka attorney representing displaced ticket holders, urged Murphy to let the case proceed to the discovery phase, during which he could scour KU athletic department records for information on how the policy was developed and implemented.

“Dismissal is not warranted,” Snyder said.

Jim Oliver and Sarah Trower, KU’s lawyers, argued the lawsuit was without legal merit and did not warrant the discovery phase.

KU’s athletic department, they argued, had — and still has — the authority to require nondonors to put up $5,000 to hold on to their seats.
