City sued over proposed Wal-Mart site

Owners of northwest Lawrence land where Wal-Mart wants to build filed a lawsuit Thursday against the city, the seventh overall.

6Wak Land Investments, the property owner, filed the suit after the Lawrence City Commission this week gave final approval to an ordinance to rezone the northwest corner of Sixth and Wakarusa to essentially prohibit a “big box” store there.

“This is an action in reaction to what they did,” 6Wak partner Bill Newsome said.

The rezoning limits the biggest building at the site to 80,000 square feet. That’s smaller than the 132,000-square-foot store that Wal-Mart has proposed building there.

The lawsuit follows six previous suits filed by 6Wak and Wal-Mart since City Hall first refused to issue building permits for the site last May.

The city has spent more than $138,000 on the lawsuits so far.
