Suspect in homicides to supply DNA

A suspect facing capital murder charges for the death of an elderly Lawrence couple agreed to supply DNA samples to the District Attorney’s Office.

Damien C. Lewis, 22, appeared late Friday morning in Douglas County District Court under tight security. He spoke only two words during the entire hearing.

“Yes, sir,” he said when Judge Michael Malone asked if he would provide the DNA samples.

Prosecutors had filed a motion seeking oral swabs from the defendant in order to obtain his DNA. If Lewis didn’t give consent, prosecutors would have sought a search warrant requiring him to do so.

During the hearing, Kirk Redmond of the state’s capital murder defense team requested that Lewis be allowed to appear in court in civilian clothes.

“Given the pretrial publicity, it’s in our interest to provide Mr. Lewis with civilian clothes for all future court appearances,” Redmond said.

Lewis, dressed in a red jumpsuit, was shackled at the wrists and ankles during Friday’s hearing.

Malone told the sheriff to have court security officers bring Lewis to all future court hearings dressed in civilian clothes.

Malone also said he was in the process of deciding what comments the prosecutors and defense team will be allowed to make to the media.

This is Douglas County’s first capital murder case since Kansas reinstated the death penalty in 1994.

Lewis could face the death penalty if he is convicted of killing George “Pete” Wallace and Wyona Chandlee, both 71. They were found dead July 11 inside their home at 1530 Learnard Ave. Prosecutors say Lewis shot them both when they interrupted a burglary.

Lewis is scheduled to be back in court for a preliminary hearing Nov. 14.
