Second brother ordered to prison

The second of two brothers charged two years ago in a shooting that left a Lawrence man paralyzed is headed to prison.

Ronnell McGautha, 20, Lawrence, was sentenced Tuesday to 71 months, or nearly six years, in prison for aggravated battery. He also will serve a concurrent 11-month prison sentence for possession of cocaine in an unrelated case.

McGautha pleaded guilty to the charges Sept. 5 before Judge Jack Murphy. Other charges of aiding and abetting attempted first-degree murder and possession of a firearm were dismissed.

McGautha and his brother, John McGautha, 19, Lawrence, were arrested after the June 17, 2000, shooting of Allen Toshavik, 20, in eastern Lawrence. The shooting occurred after the McGauthas and Toshavik had a dispute after a night of drinking and drug use.

During a trial in December 2001, a jury found John McGautha guilty of attempted second-degree murder and criminal possession of a firearm. He later was sentenced to serve nearly nine years in prison.

Ronnell McGautha has been held in the Douglas County Jail since he was brought over from Jackson County, Mo. He underwent a drug treatment program in Missouri after being convicted for drug trafficking.
