Judge to make ruling in 10 days in Sebelius lawsuit

? A state judge Thursday said he would decide within 10 days whether Gov.-elect Kathleen Sebelius broke state law by closing to the public her task forces reviewing state government.

A group of news organizations, including the Lawrence Journal-World, filed suit arguing that Sebelius’ Budget Efficiency Savings Teams (BEST) are subject to the Kansas Open Meetings Act, which requires that most governmental business be conducted in the open.

Sebelius selected the five BEST teams, with more than 50 members, as part of her campaign promise to conduct a comprehensive review of state government. She then closed the groups’ meetings to the media and public.

A state attorney representing Sebelius said the task forces were not subject to the open meetings law because Sebelius is not yet officially governor.

After hearing arguments and testimony in the case, Shawnee County State District Judge Eric Rosen said he would have a decision within 10 days.
