Officer testifies suspect in arson claimed to be five miles from ex-girlfriend’s home

A Lawrence arson suspect told police he was taking a walk when he received phone calls that his ex-girlfriend’s mobile home was on fire five miles away, a Lawrence police detective testified Wednesday.

But children in the mobile home park told investigators they saw the suspect near the mobile home around the time of the fire, according to testimony from a fire investigator.

Trevor Toussaint, 44, faces arson and burglary charges and is accused of setting fire on June 10, 2008, to the mobile home, at Harper Woods mobile home park, 2200 Harper St. Several witnesses testified Wednesday during the third day of his jury trial in Douglas County District Judge Paula Martin’s courtroom.

Kimberly Berry, the homeowner, has said she tried to break off a romantic relationship with Toussaint the night before the fire and started to see another man. Prosecutor Eve Kemple said Toussaint burned the mobile home as an act of revenge.

Fire investigators have ruled the blaze was set intentionally after gasoline was poured onto Berry’s bed and in the hallway, and then ignited.

Defense attorney Charles Whitman has disputed that Toussaint was identified as the person who broke into the mobile home that day.

Martin told jurors the trial would likely conclude Thursday.
