Jurors again hear Westar auditor testimony

? Jurors were to continue deliberations Wednesday in the federal fraud trial of two executives accused of looting Kansas’ biggest electric utility.

The third day of jury discussion, on Tuesday, brought a request from jurors for a repeat of the testimony from a former auditor at Westar Energy Inc., where the alleged fraud took place.

The court reporter read the 31-minute testimony given Nov. 3 by Jenny Tryon, Westar’s former director of internal audit.

Tryon testified that an official at the Arthur Andersen accounting firm, which advised Westar on its audits, suggested she audit the logs of company planes.

But when Tryon told former Westar chief executive David Wittig of the suggestion in a meeting around the week of Nov. 19, 2001, he advised her not to.

“He continued saying, ‘You’re not doing it,'” Tryon said.

Prosecutors claim Wittig and former Westar executive vice president Douglas Lake used company planes for personal travel.

Wittig and Lake each face 40 charges, including wire fraud, money laundering, conspiracy and circumvention of internal controls.

Both men have denied wrongdoing, saying their actions were approved by the company’s board of directors and publicly reported.
