Douglas County Commission to consider amending county code regarding small-scale industrial use

The Douglas County Commission will consider on Wednesday a text amendment to the county code that would allow small-scale industrial uses in rural areas with the approval of a conditional use permit.

The text amendment, which requires a public hearing, comes to the commission with the Lawrence-Douglas County Planning Commission’s unanimous recommendation for approval. In a report to commissioners, Mary Miller, planner for the Lawrence-Douglas County Planning Department, writes that the text amendment is seen as a transitional step between home businesses, which are permitted with planning staff’s administrative review, and applications large enough to require industrial rezoning.

Among the restrictions written into the text amendment is that all business activity be confined to within a structure or structures of no more than 10,000 square feet, that there be no outside storage, that the activity generates no off-site effects such as noise, glare or vibrations and that the business can have no more than the equivalent to 15 full-time nonresident employees.

A wide range of possible light manufacturing, product assembly and food production activities are listed as possible candidates for the permit. They include the manufacture of musical instruments, watches, clocks, toys, games, and electrical or electronic apparatus, baked goods, candy, dairy products and ice cream. Activities involving the slaughter of animals are excluded.

In other business, the County Commission will:

• Receive an update on the Criminal Justice Coordinating Council from its coordinator, Robert Bieniecki.

• Consider the renewal of Community Living Opportunities’ conditional use permit for Midnight Farm, a therapeutic farm at 2084 North 600 Road. Staff recommends renewing the permit for another 10 years with the stipulations it participates in the dust reduction program the county engineer recommends and that an outdoor pavilion be shown on the farm’s site plan.
