Journal-World appeals ruling that sealed affidavits in KU sexual assault cases

The Journal-World on Monday filed an appeal with the Kansas Supreme Court seeking the release of arrest warrant affidavits in the cases of two men who were charged with rape in connection with Sept. 28 incidents at a Kansas University residence hall.

Charges against the men were dropped earlier this month, and Douglas County District Judge Kay Huff ruled that the affidavits, which lay out the reasons for the men’s arrests, should remain sealed because the cases were dismissed.

In Monday’s filing, Journal-World attorney Max Kautsch argued that Huff did not follow proper procedure and did not make findings sufficient to keep the affidavits under seal. He asked that the Supreme Court send the issue back to Huff and direct her to make specific findings that justify sealing or redacting the affidavits.

One of the men originally charged spent eight days in jail before posting a $50,000 bond on Oct. 14. The other man spent nine days in jail before posting a bond of the same amount.
