Bottom Line

City commissioners will finalize a set of conditions related to a permit for Lawrence Community Shelter to relocate to a warehouse adjacent to the Douglas County Jail, 3601 E. 25th St., in eastern Lawrence.

Background

Commissioners gave the permit preliminary approval at their meeting last Tuesday, but said they wanted to fine-tune the conditions that would be placed on the special use permit. Among conditions proposed for the permit are:

• Placement of a bus stop near the shelter site before the shelter begins operation.

• A requirement that a building permit be pulled on the project within 12 months of the approval of the special use permit. Commissioners can extend the timeline, but it would take approval from four of the five city commissioners.

• Approval of a detailed management plan for the shelter before Aug. 1. That plan also would have to be approved by four of the five commissioners. Any changes to the plan after its adoption also would have to be approved by three-quarters of the commission. The three-quarters majority is a requirement because neighbors had filed a valid protest petition against the shelter, which required the permit to be approved by a super majority.

Other business

• At 5:30 p.m., the commission will meet with Douglas County commissioners and the Douglas County Kaw Valley Drainage District. About 6:35 p.m., the regular commission meeting will begin.

• Proclaim: Monday through Friday as Tree City USA Week and Friday as Arbor Day; Tuesday as Friends of the Park Day; May as Huntington’s Disease Awareness Month; and May as Tennis Month.

Consent agenda

• Approve minutes from March 9 meeting.

• Receive minutes from the Feb. 20 Sustainability Advisory Board and the Feb. 15 Public Health Board meetings.

• Approve claims.

• Approve licenses recommended by the city clerk’s office.

• Approve appointments recommended by the mayor.

• Consider these bids and purchases:

a. Authorize purchase of five paratransit vehicles (T-Lifts) to replace five paratransit vehicles that have surpassed both the manufacturer and Federal Transit Administration useful life requirements from Kansas Truck Equipment Co. for $250,000. The purchase will be paid with Kansas Department of Transportation funds.

b. Award bid for a low-speed electric vehicle for the utilities department to M&M Golf Cars for $11,947.

c. Award bid for a heavy duty dump bed and hoist for the public works department to American Equipment for $18,992.

• Adopt on first reading Ordinance No. 8520, authorizing the sale, possession and consumption of alcoholic beverages at Broken Arrow Park on May 7-8 for the Lawrence Sertoma BBQ Cook-off and fundraiser.

• Adopt ordinances on second and final reading that would:

a. Permit possession and consumption of alcoholic liquor on public property pursuant to the sidewalk dining license for 715, 715 Mass.

b. Authorize temporary possession and consumption of alcoholic liquor on public property related to the Tour of Lawrence event on July 2 and July 4.

c. Authorize sale and conveyance of the Sunshine Property LLC project (Microtech Computers Inc., 4921 Legends Drive). All obligations of the 1997 industrial bond issuance have been performed allowing the transfer.

• Approve rezoning and adopt on first reading an ordinance rezoning about 5.252 acres from IG (general industrial) to IL (limited industrial), at 151 McDonald Drive. Submitted by Paul Werner Architects for Downtown Equities II LC, property owner of record.

• Approve text amendment and adopt an ordinance to permit Hotel/Motel/Extended Stay Use as an allowed use in IL zoning, revise the maximum height in the IL District and add reference to the IL District in footnotes 14 and 15 in the Density and Dimensional Standards.

• Approve special event permit for a Jim Clark Motors auto tent sale at the Sears parking lot, 2727 Iowa, from April 29 through May 1.

• Approve temporary use of right-of-way permit for the Lawrence Art Guild to close Massachusetts Street from North Park Street to South Park Street from 6 a.m. to 7 p.m. May 2 for 2010 Art in the Park art fair.

• Authorize the mayor to sign a release of mortgage for Tasha Taylor, 2504 Bonanza.

• Receive Lawrence Freenet’s fourth quarter 2009 report.

• Authorize the 2010 Lawrence Cultural Arts Commission Community Arts Grants awards as recommended by the Lawrence Cultural Arts Commission.

Regular agenda

• Consider on second and final reading an ordinance for a special use permit for establishment of a temporary shelter for the Lawrence Community Shelter, approximately 4.15 acres, at 3701 Franklin Park Circle.

• Consider a request for the use of a one-year facility use agreement for the Lawrence Indoor Aquatic Center with Ad Astra Area Aquatics for the 2010 swimming season.

• Consider directing staff regarding establishment and location of 15-minute parking downtown and adopt on first reading Ordinance No. 8518, establishing 15-minute parking spaces downtown

• Receive staff report on habitual parking violator ordinance.

• Receive staff report regarding a sidewalk dining and hospitality license for Louise’s downtown, 1009 Mass.

• Consider adopting on first reading Ordinance No. 8516, amending Chapter 6 Article 14 of the city code regarding licensed street vendors.

• Consider approving the Iowa Street reconstruction project from Yale Road to Bob Billings Parkway/15th Street intersection, including center turn lane, funding sources and inclusion into the Lawrence/Kansas Department of Transportation five-year Capital Improvement Program.
