City commissioners will discuss whether they want to make any changes to the city ordinance requiring residents to shovel snow from their sidewalks.

Background

The city’s ordinance has been questioned because it gives residents five days following the end of a snowfall to clear their sidewalks before a $20 fine is issued. Other cities have a much shorter time period and higher fines. Other cities also have ordinances that give city crews or a city-hired contractor the ability to remove the snow from a sidewalk and bill the property owner.

¢ Adopt on first reading, Ordinance No. 8235 establishing the City Commission quorum at four commissioners. Pursuant to Charter Ordinance No. 25, the City Commission quorum of four commissioners must be annually re-established by ordinance by March 31.

¢ Adopt the following ordinances on second and final reading:

a.) Ordinance No. 8197, condemning certain property interests for the West Baldwin Creek Sanitary Sewer Project.

b.) Ordinance No. 8239, enacting Chapter 5, Article 19, of the code of the city of Lawrence pertaining to Underground Wiring Districts.

c.) Ordinance No. 8240, enacting Chapter 5, Article 20, of the code of the city of Lawrence pertaining to Siting of Utility Facilities.

g.) Ordinance No. 8236, rezoning two tracts of land totaling approximately 4.4 acres (Z-10-69-05) from RM24 (Multi-Dwelling Residential) to RSO (Single-Dwelling Residential-Office). (Note: the request originally rezoned the tracts from RM-2 (Multiple-Family Residential) District to RO-1B (Residence-Office) District.) The property is described as being north of West Seventh Street, west of Wisconsin Street (south half of 1803 W. Sixth St. and 1710 W. Seventh St.).

¢ Authorize city manager to enter into an engineering contract with BG Consultants Inc. for $14,614 for completion of Engineering Design Plans and Specifications for the proposed Traffic Signal at the intersection of West Sixth Street and Congressional Drive.

¢ Approve request by George F. Paley, property owner of 740 Ash St. for a variance from 19-214B of the code, which states that a private sanitary sewer service line shall not be located in a city public right of way for greater than 15 feet.

¢ Receive 2007 Annual Utility System Development Charges Report.

¢ Receive the Police Department’s Annual Racial Profiling Complaint Report for 2007.
