Gun charge against store owners dismissed

A federal gun charge filed earlier this year against owners of Yellow House Store, 1904 Mass., recently was dismissed.

A U.S. District Court judge in Kansas City, Kan., granted a motion by Guy and Carrie Neighbors to dismiss the charge based on the 70-day speedy trial act.

That charge alleged the Neighbors illegally possessed weapons while they were unlawful users of a controlled substance.

This was the second time the gun charge was dismissed. The couple initially were charged in December 2006. It was dismissed by the U.S. Attorney’s office in May when prosecutors said they intended to follow up with additional evidence. The charge was refiled in June.

Guy Neighbors said the fact that the charge has been dismissed twice speaks for itself.

“This whole thing has been a long, torturous, drawn-out situation,” he said.

The Neighbors still face other federal drug charges and, in a separate case, allegations of money laundering and wire fraud.
