Former employee alleges discrimination

? Jefferson County now faces two trials in U.S. District Court based on a former employee’s allegations of discrimination.

One lawsuit – in which Lynn R. Zwygart says the county violated the Americans with Disabilities Act when it failed to rehire him two years ago – is set for trial Sept. 7 in Kansas City, Kan., according to Zwygart’s attorney, Alan Johnson.

Zwygart was fired in 2003, after the county found he’d used all of his vacation and sick time while recovering from a bacterial infection and open-heart surgery. When Zwygart sought another job in 2005, he alleges the county’s road and bridge superintendent told him he was concerned about his health and denied him an interview. County officials say his job application wasn’t filed in time.

Another lawsuit that Zwygart filed – in which he claims he was not hired for another road and bridge job in 2006 – is set for trial April 7, 2008. Zwygart claims it was in retaliation for filing lawsuits.
