Manilla, Philippines ? Lawyers for four U.S. Marines charged with raping a 22-year-old Filipino woman asked Tuesday that the case be dismissed or suspended.

Prosecutors allege that Lance Cpl. Daniel Smith raped the woman on Nov. 1 inside a van at Subic Bay, a former U.S. naval base northwest of Manila, as fellow Marines cheered him to the beat of loud music. Smith claims he only had consensual sex.

Also charged on Dec. 27 were Lance Cpl. Keith Silkwood, Lance Cpl. Dominic Duplantis, Staff Sgt. Chad Carpentier, and Timoteo Soriano, the Filipino driver of their rented van.

Smith’s lawyer, Benjamin Formoso, filed a motion asking Judge Renato Dilag to dismiss the complaint against his client for lack of probable cause.

John Coluso, a lawyer for Silkwood and Duplantis, said he was filing an urgent motion to suspend proceedings against his clients. Carpentier’s lawyer filed a similar motion.
