Man jailed for shooting soldier in plot to avoid Iraq

? A man who shot his cousin’s husband in the leg last year to help the soldier avoid a second tour of duty in Iraq was sentenced Friday to 15 to 30 months in prison.

Roland Fuller, 29, of Philadelphia pleaded guilty in July to aggravated assault, conspiracy and a weapons violation.

His cousin, Donna Roberts, 34, of Summerdale, Pa., is scheduled to be sentenced Monday. She pleaded guilty in April to criminal solicitation, conspiracy and a weapons offense.

The soldier, Army Spec. Marquise Roberts, 24, is serving a yearlong sentence in military custody at Fort Bragg, N.C.

“I cannot condone an act of this nature,” Common Pleas Court Judge A.J. DeFino told Fuller on Friday. “It would be very, very unfair to all those men and women in Iraq, and it would set a very bad precedent.”

DeFino also sentenced Fuller to two years’ probation.

“Any person who causes a situation like this – it’s dangerous. It really is dangerous,” DeFino said.

Marquise Roberts initially told police he was shot in the back of the leg on Dec. 14 while walking with Fuller.

But police could find no physical evidence at the site, and Fuller’s account did not match Marquise Roberts’ statement.

Eventually, Marquise Roberts admitted that he and his wife hatched the plan so the soldier would not have to return to Iraq. Fuller shot Roberts in a wooded area.

Fuller’s attorney, Craig Mitnick, said his client fell sway to his cousin’s “very strong emotional appeal.”

“He didn’t get paid for it. It wasn’t his gun. My client isn’t a thug. He’s a nice guy. … He did this out of his heart, even if it may have been a mistake,” Mitnick said, adding that Donna Roberts provided the handgun.

Upon his arrest, Fuller told police: “I was just trying to help him out. I felt bad for them. I know it was stupid, and I am mad at myself for doing this.”

Donna Roberts told police that some of her husband’s friends had been killed in Iraq and that he was worried about returning.

But Assistant Dist Atty. Mark Winter told the judge that Fuller put Marquise Roberts’ life at risk and could have injured others as well.
