Judge hears testimony in 2003 sex crime

A judge heard testimony Thursday but didn’t make a decision about whether a mentally retarded man convicted of a sex crime against a 13-year-old girl should be sent to prison.

Prosecutors allege Michael J. Rayton, 29, committed a long list of probation violations, including breaking curfew and drinking alcohol. But his defense attorney says Rayton never got adequate mental-health services that could have helped him succeed. According to previous testimony, he functions at roughly a third-grade level and has an IQ between 61 and 75.

Witnesses on Thursday included Rayton’s probation officer, Craig Eddis, who said he’d done everything he could to get Rayton to comply, and a doctor called by Rayton’s attorney who testified Rayton needed 24-hour supervision and shouldn’t be allowed to live independently.

Martin scheduled the hearing to continue Dec. 1.

Rayton was one of three men who received probation for having sex with the girl in June 2003 after a night of drinking at a central Lawrence apartment.
