Teen sentenced for vomiting on teacher

A high school student convicted of vomiting on his Spanish teacher has been ordered to spend the next four months cleaning up anytime someone throws up in a police car.

Johnson County Magistrate Judge Michael Farley said during the sentencing Tuesday that he considered the boy’s actions “an assault upon the dignity of all teachers.” He also said he hoped to receive a “full confession.”

The teen, now 17, was charged with a misdemeanor count of battery in June in the juvenile division of Johnson Country District Court.

During the last day of classes at Olathe Northwest High School, the teen vomited on Spanish teacher David Young as he turned in his textbook.

The boy’s attorney, Brian Costello, said the teen vomited because he was nervous about his final exams.

But two other students testified that the teen said he threw up intentionally. One girl said the teen had told her in advance that he planned to throw up on Young on the last day of school. The girl wasn’t in class when the teen threw up, but she testified that when she saw the boy later he told her, “You missed it. I did it.”

Young said the student, who was failing his class, made no effort to avoid throwing up on him.

“I was just sort of stunned,” he said.

Board of Healing Arts gets new member

The state board that licenses and regulates doctors, surgeons, chiropractors and physical therapists has a new member.

Gov. Kathleen Sebelius announced Wednesday that she appointed Dr. Howard Ellis, of Overland Park, to the Board of Healing Arts for a four-year term.

Ellis, who turns 52 today, is a gynecologist who also performs laser cosmetic surgery. He served previously on the board for eight years, leaving in 2003.

The 15-member board recently came under scrutiny over its handling of the case of Krishna Rajanna, who operated a Kansas City, Kan., abortion clinic. The board shut down his clinic in March and revoked his license in June, but abortion opponents have argued the board should have acted more quickly.

Ellis replaces Dr. Jana Jones, of Leavenworth, whose four-year term expired June 30.

Eudora man suspected in rape, kidnapping

A 54-year-old Eudora man has been arrested on suspicion of kidnapping and raping his 41-year-old girlfriend.

The woman alleged that after an argument Monday night at her Lawrence home, the man held her against her will, choked her and forced her to perform sexual acts, said Sgt. Dan Ward, a Lawrence Police spokesman.

He eventually let her leave, and she immediately notified a neighbor, Ward said.

Police found the man later Tuesday and arrested him.

The Journal-World generally does not identify suspects in sex crimes unless they have been convicted.
