Attorney for man accused of making sex video without woman’s consent hopes to get case dismissed ahead of trial

An attorney representing a man accused of making a sex video of a woman without her knowledge told a Douglas County judge Monday that he planned to argue for dismissal because of some “unusual facts.”

The accused, Garrett Christopher Lynch, 26, of Kansas City, Missouri, is charged in Douglas County District Court with one felony count of breach of privacy in connection with an incident on July 24, 2022, when he is alleged to have made a sex video of a woman he met on a dating app without her knowledge. Lynch is alleged to have later sent that sex tape to the woman’s boyfriend via social media, as the Journal-World reported.

Lynch was scheduled for a preliminary hearing on Monday, during which Assistant District Attorney Adam Carey was prepared to present witnesses to persuade the court that probable cause existed to believe that Lynch had committed the crime.

However, Lynch’s attorney, Philip Stein, said that Lynch would waive his right to have the hearing. Stein then asked the court for a date for a motion hearing when he plans to argue that the case should be thrown out.

“Some unusual facts led to the filing of this case,” Stein said without providing further detail.

Judge Amy Hanley scheduled the motion hearing for Jan. 3, 2025. Lynch is currently free on a $5,000 cash bond.
