Actually it sounds like both are at fault. She was crossing a busy street in the middle of the block and he was turning left, crossing traffic to merge with other traffic, which means he failed to notice the road wasn't clear when he turned. You should never drive your car onto a road assuming it is clear. And you should never cross a busy street in the middle of a block.

This is the reasonable outcome, both are at fault. This should not be another case in Lawrence where the injured pedestrian is the only one blamed. If we aren't going to ticket careless drivers then by God ticket them when they injure people.

Left hand turn lane is in the middle of the street, hopefully even the motorist notices what is going on there, in this case unfortunately not.

From the Kansas Driver's License Handbook:

The driver’s responsibility is greater than that of the pedestrian, since a motor vehicle
with its greater weight and speed is much more destructive.
A pedestrian sometimes does thoughtless or foolish things. But, in spite of this, if
your vehicle is under control at all times you should be able to avoid hitting him.
The pedestrians killed and injured are usually persons who are unfamiliar with automobiles
or those who are not as alert as the average person. Older persons who move
slowly and cannot see or hear well are frequently involved in such accidents.
Children are the next group most frequently involved in pedestrian accidents. They
do not realize the danger of playing in or crossing the streets

Once again, you miss the point: I just want to watch you stand on the curb and fake drivers out. My statement had nothing to do with random kids or praying for motorists.

Really it is nothing but standing right on the curb, that should be enough to make people anticipate what if. A deer running out on the highway is one thing but a human being on a 30mph street is entirely different.

She was in the turning lane, not like she just came out of nowhere. It is called paying attention. Kind of like the woman in Gardner that mowed over that little boy because at 7 years old he should have known better since the woman was in a school zone, in the middle so the kid had to cross a lane of traffic, just magically popped up out of no where. Paying attention, anticipating, it was part of the driver training that wasn't very good to begin with and for most people long ago and forgotten.

Right and when it is a kid that does it you'll be there with your prayers for the driver. I guess if being a bad driver by not driving defensively and not asking a lot of "what ifs" is what you strive to achieve for then we have done a good job. People really should be on trains if they want to go fast without needing to worry about stopping.

jamea0216 wins points for identifying why motorist get so righteous about this, because they know they to are poor drivers and that this could happen to them and need to make sure the burden of proof is placed on the most vulnerable. Think people are safe legally proceeding at the light? What about the bicyclist creamed last week legally proceeding across Iowa street? All I'm asking motorist is to stop and think about the situation from other than the comfortable, climate controlled seat in the car. Really, a little compassion to those who feel there are other ways to get around is all that is needed. Everybody is in a hurry to get home and every night there are accidents that occasionally include pedestrians and cyclist, most car on cars are not even reported. It is a real problem that we must face so these kind of accidents decline.

Often it's the poorest among us who walk, but then there are those who realize that climate change isn't some joke and who are trying to make a difference. Naturally, either of these groups are fair game in our society. The poor just didn't want success badly enough and deserve their fate. And the real greenies (not the phonies in their Priuses) are a threat to our cherished Way of LifeTM. They're no good, no how."

So true, the people who have to walk in the weather, deal with crappy sidewalks, places where rain runs over the sidewalks because we need to make it convenient for the motorist but by golly a pedestrian tries to do something for a little convenience the motorist come on to preach the law as though they understand what that is! What a joke and perfectly reflects the nature of Lawrence.
