Regarding the gas tank leak at the Presto Convenience Store: I read in the newspaper that cleanup is going to cost $500,000. Will there be any attempt by the Kansas Department of Health and Environment to sue the Presto Corp. to recover the cost that was their fault?
KDHE is unlikely to file a lawsuit. Presto has agreed to pay a $5,000 deductible and $4,900 in penalties. It also has agreed to upgrade its leak-detection systems in all 41 Presto stations in Kansas. If Presto violates the agreement, "KDHE will seek recovery of the costs of the cleanup," KDHE spokeswoman Sharon Watson said. Most of the cleanup costs will be paid by the Kansas Petroleum Storage Tank Release Trust Fund. Presto has filed a claim with the fund.
