I'd like to know by whose authority the Lawrence Community Shelter car wash was shut down on July 30. Does the city storm water quality technician have the authority to give orders to people on private property?
City Code Section 9-904B authorizes the Stormwater Quality Technician and other specific city personnel to issue and enforce violation notices, said Chad Voigt, the city's stormwater engineer.
The code also authorizes enforcement personnel to go on private property if a violation is suspected. However, Voigt said, this was not necessary July 30 because car wash wastewater was flowing in the public right-of-way. The stormwater quality technician, Voigt said, places emphasis on educating the public about pollution prevention and water quality. This was the case July 30, he said. The violation was stopped and no further actions are anticipated.
