What should be the punishment for sending massive amounts of spam?

As Nick Danger says: "...Homelss people are also good straw men for bank accouts but take them to a bank far away from the alley in which they live as they will soon foget where you have taken them and do not leave them with any banking info. You then extract the money from the account using an ATM card and the money is NOT traceable to you! Heh, heh. Did I say that?

A few years ago, a particularly prolific Russian spammer was found bludgeoned to death in his home. Considering the billions of dollars and millions of man-hours that spam costs, that punishment seems appropriate. If it were done in public, that could serve as a deterrent, too.

This is totally off the subject, and may have been commented on in previous OTS columns that I have missed, but is anyone else finding that the J-W online comes up SO MUCH more slowly now? I read several papers each day and the J-W used to be 'way the speediest to retrieve, and now it is so slow. I don't have the liveliest computer in the world, but it surely discourages me from wading through the online J-W. The new version is cleaner-looking but I wonder if it is necessary for the font to be quite that large, with as much space between the lines. Doesn't look much like a newspaper, to me. Other opinions?

Who does this sound like? "Ever noticed how all spamers seem to have Narcissistic personality disorder? ... At least five of the following are necessary for a diagnosis (as with many DSM diagnoses, they must form a pervasive pattern; for example, a person who shows these criteria only in one or two relationships or situations would not properly be diagnosed with NPD): 1) has a grandiose sense of self-importance 2) is preoccupied with fantasies of unlimited success, power, brilliance, beauty, or ideal love 3) believes that he or she is "special" and unique and can only be understood by other special people 4) requires excessive admiration 5) strong sense of entitlement 6) takes advantage of others to achieve his or her own ends 7) lacks empathy 8) is often envious or believes others are envious of him or her 9) arrogant affect " http://groups.google.com/group/news.admin.net-abuse.email/browse_thread/thread/aa081dd6c2407f6b/e3000d33721cd724?lnk=raot

fined, imprisoned and prohibited from using the internet. That guy caught has been fined before. he sends a worm virus to other people's computers then ghosts millions of email through them. he is just a criminal, only reason he didn't use a gun was he made more money this way.

beatrice 8 years, 1 month ago

I've never laughed so hard from just seeing the OTS question!

I think the punishment should be some jail time, make internet access illegal, and cutting off of their thumbs. Public embarresment is also good. Boy, if they ever find out who the spammer Nick Danger is, I hope all of the punishments suggested are applied.

Hey Marion, any suggestions on how we can locate Nick Danger? Perhaps we should check in Westwood, at night, in the alleys, as he is know to troll for (obviously) drunk women.

You are welcome, Beatrice

If there was ever a need for the Guantanamo prison, this is it. You see, spammers are terrorists.

1) They interrupt the peace and tranquility of your life on a daily basis. 2) If you do not accept their demands, they can (and will) destroy your computer or your business by virus or DOS attack. 3) Spammers have no regard for law or order. They believe they are righteous and can do whatever they want to serve their own nefarious purposes. 4) The law does not apply to them in their world. Nothing any government says means a thing to them. 5) Its hard to declare war against them since they use distributed computing (botnets) to send their spam. You can't always pinpoint the enemy very easily. 6) They consume our resources and degrade or destroy parts of our communications infrastructure.

I'm guessing this OTS was done because of the recent arrest of Robert Soloway, a well known American spammer. I've had the good fortune of actually speaking with Mr. Soloway when he began sending large quantities of spam to my corporate server. I made him an offer he couldn't refuse, and he grudgingly stopped sending spam to my domain. That being said, I would have enjoyed taking three raccoons, giving them some amphetamines, putting them in a box, and then shipping the box to Mr. Soloway.

Spammers are terrorists more than most of the people we have declared as terrorists. Spammers have actually committed acts related to my above six points. I like the idea of prison, but it just sounds too nice. It would be fitting to give them bottles of v14gr1 or c1@l1s and make them take them until they OD. In all honesty though, if a few of them were just shot (especially in countries where that isn't a problem to do cough Russia cough*) then maybe the world would be a better place for us all, and only then could we have the spammers fear us.

TOB: "I may be merely an armchair attorney..."

I didn't realize armchairs got in so much legal trouble!

I have an intense dislike for spammers. They waste my time and resources with junk in my email inbox, in my blog comments and in the referral URLs in my site statistics. Whatever punishment is given should be incredibly severe.

Death. Kill them. These people have a net negative impact on society, costing billions of dollars of wasted time and screwing millions out of millions. Let me change that, torture them to death. These vermin are international in nature and should therefore not be subject to constitutional protections regarding the nature of the punishment. Kill them, kill their families and their offspring. Exterminate their entire line.

And who cares why Vardan Kushnir was killed. The good news, no, the great news, is that he was killed. Quite appropriate. May there be many more such events to celebrate.

Gosh, I hope I don't come across as being too angry on this issue.

Uhlrick_Hetfield_III 8 years, 1 month ago

Said Mr. Lynn, demonstrating why a "by any means necessary" solution to the problem has become mandatory. Vigilante actions ruled the west when there were no other means available to control the problem, and they are probably quite appropriate in solving the problem with spammers.

Jamesaust 8 years, 1 month ago

Frankly, this would be easily solved with a progressive tax on emails with hard penalties for "tax evasion." First thousand emails a year = $0.0001 per email. Next thousand = $0.001 per email. Next thousand - $0.01; next thousand - $0.10; next - $1.00. Average people might have to fork over a penny or two (100 emails = one cent; 100 million emails = billions?). Spammers couldn't afford to operate. And taxation would easily put paid to any "free speech" argument.

"emails originating from offshore would not be subject to such a tax,

If it passes through a U.S. server, its subject to U.S. jurisdiction (long established by law). Besides, I'm certain that most every other nation would be happy to go along. Like so many other international issues, I'm sure the line up is: The World vs. the U.S. and a few rogue states like North Korea or Saudi Arabia.

"represents unwarranted intrusion by the government into the Internet" Hahaha!!! Coming from someone determined to intrude into people's bedrooms, that's rich! What's wrong? Afraid your porn addiction will become too expensive?

The sacred Internet. giggle Sorry, if your only objection is that someone's "moving your cheese" then your yippy objection is without merit.

"the power to tax is the power to destroy; you'd better think about that one for a while!"

Me? How about you? Coming from someone who objects to any attempt to regulate campaign money with the mantra that "Money=Speech" I'd say you were serving up a rich diet of Hypocrisy Pudding today! If speech is money, money is subject to taxation. Besides, the Supremes have already ruled on this one - first amendment protection does not exempt one from normal taxation.

Sorry but there's no debate on the fact that "spam" exists because email is an economic good without scalable costs. Solve that, you solve your problem. You have no more "right" to send 100 million emails for "free" than you would to send 100 million pieces of junk mail. Neither is a sacred cow.

Spammers are much akin to the home invasion types in terms of their behavior. They invade your home or office, unwanted in any way, shape, or form and disrupt your life. Marion's argument that you've invited them to come is as specious as the interpretations of law that said if you had a front door it was an open invitation and the homeowner had to flee in case of invasion instead of defending their property. The difference is, as Marion correctly points out, one of legal definition. That is why I think ultimately we need the remedy of old-fashioned vigilante law. Spamming is like pornography, we may not be able to define it too well, but we all know what it looks like when we see it. Unfortunately, these snakes hide themselves so that they can't be found, knowing full well what we'd all like to do to them.

I think we should follow the lead of some Muslim cultures and cut off, part of the offender's body to show they are a criminal. Since Spammers use their fingers to type, we cut off the little finger on their left hand.

"Bea, you can only go to jail if you are doing illegal things and get convicted. Therefore, the optimum action is to not do illegal things. You are demonstrating your ignorance again and you should stop it."

I see. Yet "Nick" wrote the following:

"ALL stock mailing is connected to a pump-and-dump plan so let's not gild the lily and let's also face reality. Is this legal? Probably not."

Interesting how one person can make claims of both being a law-abiding citizen, and a law breaking dirtbag. So it looks to me like the only thing that stands between my "ignorance" and my brilliant observation is your conviction. I suspect we just need to give it time. (The spacing in the quoted statements have been removed to cut back on the annoyance factor of the posts.)

To top this off, "Nick" added: "Is it ethical? When discussing anything connected with the stock market the terms "ethical" and "stocks" are mutually exclusive, so who cares?"

NIck, you prove to be just another unethical flag-bearer for the right who is bound to take a fall.

You are welcome, Beatrice.

Jamesaust 8 years, 1 month ago

"The "World" will not line up on anything, much less a tax on emails,"

Shows what you know - the subject has been one much discussed in recent years but action goes nowhere because the U.S. keeps saying "no." Expect a Democrat President and Congress in 2009 to sign on. (That'll leave Burma, N. Korea, and Iran saying "no" - always nice when the rare event comes up when the U.S. can be on the opposite side from those countries.)

"besides, enfrocement of that tax would be wildly invasive of privacy"

I assume you just make this stuff up. Its as difficult or invasive as the taxes that appear on your telephone bill. Marion, I believe you have what they call "learned helplessness."

The spam has hit the fan.

I'm beginning to get that sick feeling one gets when watching a bad car crash, yet I can't turn away. Marion, perhaps it is time to find yet another log-on name to give your rants. Just avoid unnecessary and annoying spacing and don't end everything with the likes of "Thanks, Dirk Diggler," and we won't know it is you right away. We will just think it is some other dilusional individual with an unwarranted and undeservingly high opinion of himself.

You are welcome.

"Oh well, Marion got kind of outed elsewhere.

And Sunday he was huffing and puffing on the bulkerforum, but still no real content. This seems usual regarding those "I have read myself up" guys. Misunderstand us correctly, there is nothing wrong with reading yourself up. Getting a pumped up ego because of it is a different matter.

"Rather than annoy the Gentle Reader with extensive lecturing, I will merely quote The Bard:"

Followed by some Shakespeare stuff. Also usual among the pumped up reading guys, when empty, quote someone bigger than you. Which appears to be adequate in their own mind. But others see them as the clowns they are. And their "wisdom" has dried out, nothing more to share. Huffing and puffing. Only anger is left to compensate for their own incompetence.

And very transparent minds. Very. In their own head they are knowledgeable with perfect plans, but in reality extremely easy to see through. But they cannot believe that either and then the next step is paranoia. A thin line there, between selfdeclared experts and paranoids. We have seen that before too."

We hope that "Nick Danger" will now just shut up, for his own sake.

There are bigger guys on bulkerforum that we should concentrate on, we should not be wasting any more of our time on a small footnote like him."

Back to the original question.....

I hate to agree with the fundamentalists on anything, but in this case I'll make an exception. The spammers send me spam on the Sabbath, which means they (or their Golems) are working on the Sabbath, which means they must be put to death. (Exodus 31:15) Can I kill them myself or do I need to report them to the guards?

denak 8 years, 1 month ago

Wow, this has been an interesting topic. Not only have I found out that Marion Lynn is actually a guy but that he is spammer also. I always wondered how Marion always seemed to post first or close to first on a topic and now I know.

As for how I would punish spammers, I would put them in a tiny room for 1-5 years and make them do nothing else but delete massive amounts of spam each day. And they couldn't just go down the list and click on all the spam and then hit delete. No, they would have to check the delete square and then go up and hit the delete button for each and every piece of junk mail.

I figure, doing this for 1-5 years, will either result in a massive aversion to the internet or they will go insane.

Either way works for me. Dena:0)

I would say the worst punishment would be 24 solid hours of reading Marion's posts. They are nothing more than Marion touting his "superior" intelligence and alcohol induced nastiness like this charming ditty:

"Uhlrick: Nobody CARES what you think! You are an insignicant little blurb on the Internet! You can't even spell "Ulrich" correctly! Put it in the proverbial bowl! Do you threaten those who send you junk mail to you mail box? No, you do not. You either read it or throw it away unopened. Do you threaten the advertisers on your favourite television programs? No, you do not. You either watch or hit the "Advance" on your TV sysltem! Do you threaten the advertisers on your favourite rock station? No, you do not. You either listen or turn down the volume. ALL major companies; Sony, HP. Dell, WalMart, Microsoft, AOL, General Motors; you just name one; even ACe Hardware, send bulk commercial email and someone buys from them or they would not send those emails! In another five years only idiots will pay for an ad in the local newspaper! (And a lot of resistance to commercial emailing comes from newspapers which are in DEP financial trouble because of the 'net!) Certain kinds of commercial emails are indeed and in fact LEGAL and work quite well. If those emails did not work, no one would bother to send them. More and more people will buy on the 'net and they will buy as the result of commercial emailing and it does not matter what you think; you do not count; this is the reality. Thanks. Marion."

Uhlrick_Hetfield_III 8 years, 1 month ago

Let me see, someone who reports that papers are in "DEP" trouble, and is a constant source of misspellings, tells me that I don't know how to spell my own name. What a sweetheart.

I think the most difficult part of your case in arguing that the members of this blog have damaged your reputation would be the presentation in court of your own postings. I don't think that there would be a lot of damage remaining that had not already been self-inflicted.

I know I haven't read more then a handful of them, and quite frankly, sir, I don't know how anyone here could damage your reputation any further than you already have through your own writings.

Indeed, may I point out that it can be libelous to accuse someone falsely of libel.

Finally, what kind of an idiot would waste his time writing lengthy messages to someone whose postings do not count for anything? How stupid do you have to be to waste time on someone when "it does not matter what you think; you do not count"?

AuntieSpammer 8 years, 1 month ago

So Mr. Lynn has written a book and sent it to Planned Parenthood? Let me guess ... you're ProLife.

Well, so am I. And I'm friggin' tired of the obnoxious, arrogant, compassionless people who have become the most vocal part of the ProLife movement. When people like Mr. Lynn tell me the government has the right to tell me I can't have an abortion, I begin to be afraid the same logic would give it the right to say I MUST have an abortion if that suited those in power at the time.

It's people like him who have convinced those with rational minds that the government needs to be kept out of reproductive issues entirely. And hypocrites like him have done more to lionize abortion providers and legitimize termination of pregnancy than anything Planned Parenthood could have done.

Mr. Lynn, I can only imagine what your book will do to negatively influence public discourse further. You do not speak for me or most of those who oppose abortion.

Quote from Marion Lynn / Nick Danger on June 5

"Marion (Marion Lynn) says:

Oh yare not only getting ready to help with the sales of my book but to bring down Spamhaus and Spam-Court; both of which have malingned me with out proof but with malice aforethought."

Compare that with the June 7 news item at http://thespamdiaries.blogspot.com/ "Thursday, June 07, 2007 Spamhaus, URIBL, SURBL under DDOS attack

This has been ongoing for a couple of days now. Spamhaus and two other major blocking list providers have been under a distributed denial-of-service (DDOS) attack."

I wonder if Nick's buddies realize just how much self incrimination is going on here? How did Nick Danger / Marion Lynn know about this attempt to "bring down Spamhaus" as he puts it, at the very moment it began?

This turkey is asking for an early Thanksgiving.

"You think that Spamhaus is such hot s++t "

LJW policy: "We want to encourage an open exchange of information and ideas. But if you use inappropriate language (even when typographically obfuscated), or make potentially slanderous or libelous comments when using this site and its features, or engage in ad hominem attacks on fellow commenters, people mentioned in stories, or any employee of The Lawrence Journal-World or The World Company, we reserve the right (but assume no obligation) to remove any and/or all of your contributions."

Marion: "A couple of idiots take a few posts out of the middle of threads ..." So you admit that you have posted information about spamming and spamming techniques under the name "Nick Danger," correct? That should help the Spamhaus investigation, which may lead to an actual criminal investigation. Remember, when in jail, if you cry and complain about not sleeping they might just let you serve the rest of your sentence at home. And, don't drop the soap, well, unless you mean to.

"silt". Yeah, yeah, sure, sure. We all believe that.

beatrice 8 years, 1 month ago

I'm just asking the question -- do you or do you post under the name "Nick Danger"? If so, don't those posts discuss how to scam people out of money using spam? Call me a Nazi if you like, but at least I don't make a living off of spamming e-mail accounts.

Flap Doodle 8 years ago

Nick, did you call for a DDOS attack on spam-court & offer to help perform such an attack? It's a simple question.

Flap Doodle 8 years, 1 month ago

From spam-court: "Posted: Mon May 07, 2007 1:24 am Post subject: Time To Do A Takedown On "Spam Court"! These (...) need the TREATMENT! "Spamhaus, Junior"! SOMEONE needs to do a "Blue Security" on them, like RIGHT THE (...) NOW! If this post reads as though I am calling for open warfare on these (...); that is EX(...)ZACTLY what I am doing! I don't have the wherewithal or the expertise, otherwise, I'd do it myself. Let me know how I can help. Thanks. Nick Danger." Edited to remove language that many would find objectionable. Nick Danger appears to be calling for a DDOS attack on a website & offering his assistance to anyone who would perform such an attack. Was this you , Marion ? Reprinted under "Fair Use"

Hunterandprey 8 years, 1 month ago

A DDOS attack? "Nick Danger" called for a DDOS attack? And offered his help in assisting? Legal? No. And since some great thinker already has brought Hitler into the discussion: He also had the bad habit of attacking people he did not like. Or so I have heard. Freedom of speech?

I must register at that bulkerforum to have a look at this freedom fighters great writings.

But where is Nick Danger actually identified as Marion Lynn? Not on the spamcourt site. So why did he call for a DDOS attack?

Be careful with all that quoting stuff snap.... sampcourt could sue you for copyright infringement. Or even worse, the teethless, but hardhitting Marion could :-p

And Marion: Would you be so kind to share how on earth your search engine ranking is improving? Give us the keywords that boost the sales of your intelligent writings. Share your wealth of your selftaught SEO expertise!

"So how do we know that Nick Danger is Marion Lynn? It is extremely easy to track him down based on publicly posted information, including identical postings made in two separate forums: bulkerforum.biz and ljworld.com...: http://groups.google.com/group/news.admin.net-abuse.email/browse_thread/thread/aa081dd6c2407f6b/e3000d33721cd724?lnk=raot

Is Marion Lynn = Nick Danger? How does anyone know?

QUOTE He posted the complete lyrics to the song "Money, Money" from the hit musical "Cabaret":

http://bulkerforum.biz/viewtopic.php?t=1500

He posted the exact same thing about a year earlier in ljworld.com:

The only differences are that of course on one he's called "Marion" and in the other he's called "Nick Danger", and included the following sentence:

Reprinted under "Fair Use". END OF QUOTE

Thanks.

Just as I suspected, you refuse to answer a direct question.

I'll just close with this -- if it walks like a spammer, talks like a spammer, writes like a spammer, and smells like a spammer ... well, Marion, I suppose you know how it ends.

You are welcome.

"What do you do for a living?" "Well, I sucker people into buying bs products that do not work and I make a killing doing it.. It's just the American way."
I think you should be forced to share a jail cell with Paris Hilton, Marion. Well, maybe not.. That might be cruel and unusual punishment. What exactly do you really do for a living, Marion? I think all of us are rather curious.

erod0723 8 years ago

I say that spammers should be forced to share a prison cell with Paris Hilton. They would probably want to kill themselves afterward.

Marion wrote: "By the time that I am finished with you useful idiots .." Waddaya mean? I can't figger that one out.

Marion wrote: "All of this due to a glitch in some software which allowed a private profile to become public for a few days!"

Later, Marion wrote (and that site xxxxxxxxxx is bulkerforum.biz, mainly a forum with some strange people on board and quite a few criminals): "When I first registered on xxxxxxxxxx, i registered under my real name. Silly me!; I may have had to many Grey Goose/Sevens that day and by the time I realised that profiles were public it was too late to do anything about it even though I removed the info." A software glitch! That suddenly became a brain glitch. People will call a guy like that a "rat-brain". I will of course not call him that. Or say "You can't fix stupid!". I will of course not say that either. But mind the door on your way out.

On bulkerforum.biz a guy called "Nick Danger" wrote: "Was just getting ready to get started in the biz when SH blew up! Don't worry, although I am new to the biz, I have my own clients waiting for me; in fact, chomping at the bit!" (note: "SH" was the old spammers forum, specialham.com)

Ready, set. But not quite ready to "go" that guy. I wonder how it went after he got tips on offshore servers and other shady spamming tools? He "already have my offshore merchant accounts".

A total failure again, Marion? Or did you actually send some? If so, how did it go? Or did you have to hire somebody because you don't have a clue on how to ACTUALLY send, just a vague idea in your head how it is done? There it is; YOU have never sent anything, but you have HIRED a spammer to do it. Is that correct, Marion?

snap wrote: "Nick, did you call for a DDOS attack on spam-court & offer to help perform such an attack? It's a simple question."

Marion: "As far as I know and what my research into the matter indicates is that the "post" to which you refer is a complete forgery ...." "As far as I know"! Hehe, "had to many Grey Goose/Sevens that day" again Marion? Backpeddling! Scared! Running!

Marions thoughts about SEO are wrong. His claims are wrong about hits/sales. This is elementary. But to give him a chance: Show the readers! Website, logs, screenshots! On second thought, that would be Mission Impossible. Forget it, you don't have a clue. Well, I think you have. Because you know you are lying about hits and sales. So just forget answering that one. Unless the answer is: "Yes, you know more about SEO than me and I am only making that stuff up". Again: Mind the door on your way out.

"Nick Danger, backpeddling in the mud" Or just refusing to give REAL answers. Pathetic old man.

Next time you plan on posting something Marion, try a pair of boxing gloves. Extremely useful tool for guys who make themselves look like complete idiots when posting on the .net.

Heh, heh. Did I say that?
