Human trafficking charges against a Lawrence woman dropped after alleged victim leaves area

A Lawrence woman accused of acting as a runaway girl’s pimp will be released from jail and the felony criminal charges filed against her will be dropped, a judge ruled Wednesday.

Jakaynah Maylene Burtzloff, 18, was arrested on Aug. 10 and faced two felony counts of aggravated human trafficking.

On Wednesday Burtzloff appeared in Douglas County District Court, where prosecutor Mark Simpson requested to drop the case against her.

The hearing on Wednesday was meant for Judge Peggy Kittel to weigh the evidence against Burtzloff; however, Simpson said the alleged victim could not be contacted. As such, the case could not move forward.

When police picked up a 17-year-old runaway girl in May she told them Burtzloff had encouraged and helped her to sell sex to two men in Lawrence, according to an arrest affidavit.

An arrest affidavit is a document filed by police explaining the grounds for an arrest. Allegations within the affidavit must still be proved in court.

The teenager told police she ran away from Florida and had also been involved in a human trafficking case in Dallas, the affidavit says.

Simpson said the teenager, who is a Florida resident, had run away again.

“We don’t have any contact with her or any way to get her here,” he said. “So given that situation, the state moves to dismiss the case without prejudice.”

Kittel granted Simpson’s request and briefly spoke to Burtzloff, explaining the situation.

“That means you’ll be released on this charge today,” she said. “I don’t know if you have any other holds on you, but this case will be concluded.”

No criminal charges have been filed against Burtzloff in Douglas County since her arrest in August.

However, Kittel told Burtzloff, if prosecutors are able to contact the case’s alleged victim, then she may face felony charges once more.

“If the state locates this young woman and decides to go forward with the prosecution, they can refile the charges,” she said.
