Lawrence man guilty in child paid-sex case

A 36-year-old Lawrence man was found guilty Wednesday of indecent solicitation of a child after paying to have sex with a teenaged girl in 2013.

Hermelindo Cano Espinobarros was originally charged with aggravated indecent liberties with a child and buying sexual relations in October 2013. However, as part of a plea agreement with prosecutor Mark Simpson, Espinobarros pleaded no contest Wednesday to the lesser indecent solicitation of a child charge.

The case was connected to that of Crescenciano Donato Hilario, who was sentenced to nearly five years in prison after pleading no contest in April 2013 to one count of aggravated indecent liberties with a child. Prosecutors had accused Hilario of taking advantage of a then 14-year-old girl who had become drunk at a party at a Lawrence apartment complex in January.

Espinobarros’ crime occurred with Hilario’s same victim between Jan. 6 and Jan. 14.

Sentencing is scheduled for Nov. 6, after which Espinobarros will likely be released from jail on time served. The maximum sentence Espinobarros could receive is 19 months in prison, depending on his criminal history, and he has been in the Douglas County Jail for more than two years on a $25,000 bond.

“He has more than exhausted his sentence,” Espinobarros’s attorney, Branden Smith said.

But when he gets out of jail, Espinobarros will be required to register as a sexual offender for 25 years and will also be on parole for the rest of his life. That is, however, if he is not deported. Espinobarros is not a legal resident of the United States and has been on an immigration hold with the Immigration and Customs Enforcement since his arrest.

Espinobarros will remain in the Douglas County Jail until his sentencing hearing.
