Lawrence man convicted of two sex crimes gets different attorney; sentencing continued

A 37-year-old Lawrence man who was convicted of attempted rape and aggravated criminal sodomy last month dismissed his attorney on Monday. His sentencing hearing has been rescheduled for July 22.

The defendant, Orion Mark Graf, pleaded no contest in a separate case last year to two counts of breach of privacy after secretly videotaping people in dressing rooms in downtown Lawrence in 2012 and 2013. In that case, investigators found a small battery-operated camera linked to Graf in the changing room at the Gap, 643 Massachusetts St., and later found 17,000 video clips on his computers featuring “hidden camera videos in locations where people were naked.”

While investigating that case, investigators found evidence that led to the attempted rape case. Lawrence police Detective James Schneider said at a preliminary hearing in July 2014 that he discovered photographs that appeared to show a female victim unconscious while “sexual acts” were being performed, according to court documents. The victim was 18 years old when the crimes were alleged to have occurred.

In the breach of privacy case, Graf was given 16 months of probation. Since he was on probation when he was arrested in the attempted rape case, he will be required to finish out the 16-month sentence in prison.

Graf was scheduled to be sentenced in the attempted rape case on Monday, but instead filed a motion to dismiss his court-appointed attorney, Branden Smith. Douglas County District Judge Sally Pokorny granted his motion, appointing Lawrence attorney Michael Clarke to replace Smith.

The sentencing hearing was set for July 22 to give Clarke time to review the case.

Pokorny said in May that both of Graf’s crimes carry a minimum of 55 months to a maximum of 247 months in prison, depending on Graf’s criminal history. He could also be required to pay a $300,000 fine. Upon release from prison, Graf will be required to register as a sex offender for the rest of his life, Pokorny said.

Graf has remained in the Douglas County Jail on a $300,000 bond since his June 2014 arrest.
