25 years ago: Mall developer pursues lawsuit against city

From the Lawrence Daily Journal-World for Jan. 27, 1990:

A trial date of Oct. 23 had been set in Douglas County District Court in a suit brought by a Cleveland shopping mall developer against the city. Jerry Cooley, the city’s attorney, said the date had been set at the conclusion of pre-trial hearings earlier this week. The developer, Jacobs, Visconsi & Jacobs, had filed suit against city officials in May 1988 protesting the city’s refusal to rezone 61 acres on South Iowa from single-family residential to general commercial zoning. Owners of the property — Richard Armstrong of Baldwin and Betty Grisham of Shawnee — had joined JVJ in the lawsuit. In 1989, Douglas County District Judge James Paddock had dismissed several claims brought against the city. The October trial was to decide whether the city had acted reasonably and lawfully in denying the rezoning.
