DA doesn’t charge Lawrence police officer arrested on suspicion of domestic violence, kidnapping charges

Pending additional investigation, the Douglas County District Attorney’s Office decided Wednesday not to charge a Lawrence police officer who was arrested Tuesday morning on suspicion of domestic battery, aggravated battery, aggravated assault, kidnapping and criminal threat.

William Jacob Burke, 32, of Lawrence, was accused of restraining, battering and threatening the victim, with whom he has a “domestic relationship,” during an incident last month, police spokesman Sgt. Trent McKinley said Tuesday. Police received the domestic violence report Monday.

Cheryl Wright Kunard, an assistant to the district attorney, said that after the Lawrence Police Department briefed the DA’s office on the case Wednesday morning, the office did not believe there was sufficient evidence to charge Burke at this time.

“It was determined additional information was necessary before criminal charges could be considered,” Wright Kunard said.

The investigation into the domestic violence accusations is ongoing, Wright Kunard said, and “the District Attorney’s office will make a charging decision once a completed investigation has been provided.”

Burke was set appear in court for formal charging Wednesday afternoon, but was released from the Douglas County Jail an hour before his scheduled appearance.

McKinley said that as of Wednesday afternoon Burke remains on paid administrative leave following his arrest.

A domestic battery conviction is one of several factors that disqualify police department applicants from receiving employment. If Burke is formally charged, the city manager will review and determine if Burke should be changed to unpaid status, McKinley said.
