Lawrence resident who fled to Europe with daughters is indicted on three counts, including parental kidnapping charge

Samantha Elmer, 33, was arrested by FBI agents Tuesday evening at the airport in Kansas City, Mo. She is currently held in the Leavenworth Detention Center until a detention hearing on Monday.

A federal grand jury in Kansas City, Kan., on Thursday indicted Samantha Elmer, the 33-year-old Lawrence woman accused of fleeing with her two daughters to Europe, on three criminal charges.

Elmer was charged with one count of parental kidnapping, one count of making a false statement on a passport and one count of aggravated identity theft, a news release from U.S. Attorney Barry Grissom’s office said.

Elmer was initially charged with two counts of aggravated interference of parental custody until the grand jury handed down formal charges.

Elmer is accused of taking her daughters to Europe in October to keep her former husband from getting custody of them. She is also accused of falsely stating her former husband consented to the passport application, falsely affixing the signature of a notary public who did not witness the signing of the application, and forging the notary’s signature, authorities have said.

Elmer faces up to three years in prison and a fine up to $250,000 for the parental kidnapping charge, a maximum of 10 years and $250,000 for the false statement on a passport charge and a mandatory two years for the identity theft charge, Grissom’s office said.

In a separate case, Elmer has outstanding charges for alleged credit card theft in Johnson County.

Elmer also had a second detention hearing on Thursday.

During the first hearing on Monday, Elmer’s attorney said Missouri child welfare records indicated that Elmer’s former husband, Justin Bush, of Smithville, Mo., may have been abusive to the girls. Bush has denied that.

After the first hearing, Magistrate Judge David Waxse ordered Elmer to be released from federal custody, which meant she would have been transferred to Johnson County to face trial in the credit card case.

But assistant U.S. Attorney Chris Oakley appealed that decision, and on Thursday U.S. District Judge Carlos Murguia agreed with Oakley and ordered Elmer held pending trial. Elmer is being held at the maximum security Leavenworth Detention Center.
