An Ottawa man has been sentenced to more than four years with the Kansas Department of Corrections after being found guilty in the accidental shooting of a 4-year-old boy in January. A judge will decided later this month whether he serves the sentence in prison or on probation.

Brian K. Bruno, 40, was sentenced today in Franklin County District Court after being found guilty last month of aggravated battery and child endangerment. District Judge Thomas H. Sachse sentenced Bruno to 52 months for one count of aggravated battery, with another 12 months for child endangerment to run at the same time.

Bruno was arrested and charged on Jan. 4 after a boy was accidentally shot in the leg with a handgun at his home in the 1100 block of North Oak Street in Ottawa. The boy survived the shooting and no one else was injured. Bruno was not the boy’s parent but did live in the same home. He pleaded no contest to the charges last month as part of an agreement with prosecutors.

Bruno will be required to register with state authorities as a violent offender. Today, Bruno’s attorney Brian Hastert filed a motion asking the judge to depart from the state’s sentencing guidelines and issue a sentence of probation rather than prison. Sachse took that motion under advisement and will issue his ruling on Sept. 30.
