Appeals court affirms Lawrence man’s child molestation conviction

— A panel of the Kansas Court of Appeals has affirmed the conviction of a man who was accused of molesting a 4-year-old girl at a rural Lawrence day care center in 2009.

The judges said the evidence was sufficient in sentencing Richard Gonzalez, now 71, to two sentences of 25 years to life for aggravated criminal sodomy and aggravated indecent liberties with a child.

The panel did order that Gonzalez's sentence delete the requirement that Gonzalez be subjected to lifetime electronic monitoring if paroled. The court said only the parole officials can order that condition.

Prosecutors said Gonzalez molested the girl during nap times over several weeks at a day care center southwest of Lawrence.

Defense attorneys had argued the girl had an overactive imagination and that investigators improperly interviewed the girl, which caused her to detail the allegations.
