City commissioners will reconsider a rezoning request that would allow retail development on 146 acres at the northwest corner of Sixth Street and the South Lawrence Trafficway.

Background

City commissioners in September balked that the proposed retail zoning for the property. The site once was proposed to house a 181,000-square-foot recreation center. But plans for that facility shifted to an area near the northeast corner of Sixth Street and the South Lawrence Trafficway. Commissioners said they were less comfortable with the retail zoning if there was not going to be a recreation center on the site. But the property’s ownership group, which is led by Lawrence businessmen Duane and Steve Schwada, are lobbying that the retail zoning is still necessary to serve the recreation and sports park that will be across the highway from the site. The Lawrence-Douglas County Planning Commission in October couldn’t come to an agreement on whether to recommend retail zoning for the site. Commissioners sent the item back to city commissioners asking for more time for the Planning Commission to study the issue. Commissioners will consider that request on Tuesday.

a. Award bid for leasing 70 golf vehicles for the Parks and Recreation Department to E-Z-Go/PNC Equipment Finance, LLC for $56,714 per year for the next four years.

b. Authorize the City Manager to execute Change Order No. 2 to the construction contract with EmCon Inc. for priority group I of Project UT0919CS General Wastewater Pumping Station Improvements increasing the contract amount by $41,094.75 and contract time by 63 calendar days.

c. Authorize the City Manager to enter into an agreement with the KERN group for a marketing campaign to attract and retain retirees in Lawrence and Douglas County for $17,250.

d. Authorize the City Manager to execute the Enterprise License Agreement with ESRI for $50,000 for 2013 with options to renew up to three years for a total of $150,000.

• Adopt these ordinances on second and final reading:

a. For Special Use Permit for the City of Baldwin and Rural Water District No. 4 Metering Station, a Minor Utility, located at 4100 O’Connell Road.

b. To rezone about 20 acres, from County A (Agricultural) District to GPI (General Public and Institutional Uses) District, located east of Kansas Highway 10 and north of Sixth Street adjacent to the Baldwin Creek City Park.

c. For Special Use Permit for an Institutional Development Plan for development of General Entertainment and Spectator Sports, Active Recreation, and Outdoor and Participant Sports and Recreation uses on approximately 90 acres in the northeast quadrant of the intersection of Sixth Street and Kansas Highway 10.

• Authorize the city manager to sign a letter of interest in teaming with KU in a research grant opportunity to evaluate dual fuel use on heavy-duty vehicles.

• Authorize mayor to sign City-State agreement for a Kansas Department of Transportation project along Iowa Street, 29th Street to south city limits.

• Approve staff recommendation to fund Lawrence Cultural Arts Commission request for additional funds in the amount of $5,000 for the 2013 Outdoor Downtown Sculpture Exhibition.

• Authorize distribution of the Employee Healthcare Plan Request for Proposal on or before Jan. 25.

• Receive the 2012 Annual Utility System Development Charges Report.

• Authorize the Mayor to sign a Subordination Agreement for Craig Nowatzke, 838 Oak.

b. Amendment to the city’s Land Development Code, Articles 1, 2 and 13, to provide for a CC600 (Community Commercial) District.

c. Rezoning about 146 acres in the northwest quadrant of the intersection of Sixth Street and Kansas Highway 10 from agriculture and neighborhood business districts to the pending community commercial district to accommodate a regional recreation facility.

• Consider approving the 2013 Comprehensive Street Maintenance Program.

• Receive request from Tony Krsnich for neighborhood infrastructure and public improvements within the Warehouse Arts District/East Lawrence Historic District, including the Cider Building, 810/812 Pa.
