Lawrence Municipal Court Judge Scott Miller Thursday postponed a trial for a Lawrence man who is accused of shooting a stray cat last year.

On Thursday, a defense attorney said the city had not yet provided him a DVD that contained evidence, including photos.

City prosecutor Jerry Little also said prosecutors were now alleging defendant Jimmy R. Wilkins, 73, shot the cat on May 29 and not May 30. Lawrence police had said animal control officers rescued the 2-year-old cat, later named Bullet at the Lawrence Humane Society, from a trap at a mobile home park in the 100 block of Michigan Street after the cat was shot twice. And officers have said a witness alleged he heard a neighbor shoot what sounded like a gun earlier in the day before he observed the cat in the trap.

Defense attorney Hatem Chahine has said Wilkins was innocent and has an alibi because he was visiting his sister that Memorial Day weekend and so he was not in the area.

The trial was scheduled to begin Thursday morning. Little said prosecutors were not aware the DVD existed until Jan. 11, and Chahine was expected to be able to review it later Thursday.

“Certainly it would have been better practice in this case to turn over the DVD much earlier than on the eve of trial,” Miller said.

Wilkins faces charges of animal cruelty and discharging a firearm in the city limits.

The trial is now scheduled for March 1. The cat recovered from its injuries and was later adopted.
