Lawrence resident Denzel Daniels convicted of aggravated sexual battery

A 22-year-old Lawrence man has pleaded no contest to aggravated sexual battery in connection with an April 2010 incident at a Lawrence apartment, according to Douglas County District Court records.

Denzel Stephon Daniels entered the plea Friday, and District Judge Peggy Kittel convicted him. Daniels had faced a trial later this month on rape and aggravated burglary charges in the case.

At an April preliminary hearing, a 20-year-old woman testified she was intoxicated early on April 24, 2010, after a night of drinking. She alleged that she woke up the next morning to Daniels sexually assaulting her. The woman testified she had blacked out and last remembered one of her friends helping her to the couch after giving her a ride home from The Pool Room, 925 Iowa.

The woman said Daniels was her acquaintance but didn’t know how he got into her apartment at Campus Court at Naismith Apartments, 1301 W. 24th St. The woman’s friend, who said she did not lock the victim’s apartment because she didn’t have a key, had also testified that she had placed the woman on the couch and that no one else was in the apartment when she left about 2 a.m.

The victim testified that Daniels left the apartment when she became upset and that she called police the next day after talking with friends.

Kittel scheduled a sentencing hearing for Daniels for Dec. 2, and, according to state guidelines, he faces from 31 months to 11 years in prison, depending on his criminal history. Under state law, if Daniels has no past felony convictions, his attorney could ask Kittel to place him on probation.

Daniels remains free on $10,000 bond.
