Douglas County district attorney will not charge suspect in hockey stick incident

A 37-year-old Mission man who was arrested on an aggravated assault charge Tuesday afternoon has been released from jail because the victim in the case did not want to prosecute, Douglas County District Attorney Charles Branson said Thursday.

Lawrence police said Tuesday the man was a clerk at Conoco, 955 E. 23rd St., and got into an argument with a man inside the store about 4 p.m. Tuesday. The man threw small plastic bottles at the clerk and left to get in a van. The clerk was then accused of using a hockey stick to shatter the driver’s side window of the van and break the driver’s side mirror with a step ladder.

Police said an off-duty officer witnessed the incident and that it was an apparent confrontation about a relationship and over a female. The clerk was arrested on charges of aggravated assault and misdemeanor criminal damage, but he was released Wednesday afternoon when no charges were filed, Branson said.
