Wichita ? The state of Kansas has asked an appeals court to stay a judge’s order blocking enforcement of a law stripping a Planned Parenthood chapter of federal family planning funds.

A notice of appeal filed Tuesday with the 10th Circuit Court of Appeals seeks to stay the injunction issued last week by U.S District Judge J. Thomas Marten while it appeals.

Marten ruled the statute was unconstitutional because it intended to punish Planned Parenthood of Kansas and Mid-Missouri for advocating abortion rights and would likely be overturned. He also found that the law unconstitutionally imposed additional restrictions on a federally-funded program.

Marten’s temporary injunction blocked enforcement of the state statute and ordered the state to continue its funding until the case was decided.

The state contends Marten erred in that decision.
