Wal-Mart Stores Inc. has filed a lawsuit in federal court alleging a Minnesota-based company was negligent in supervising construction of a retaining wall on property of the Lawrence store near Sixth Street and Wakarusa Drive.

According to the suit filed Monday and assigned to U.S. District Judge Carlos Murguia in Kansas City, Kan., Wal-Mart alleges New Technology Resources Inc., doing business as Millenia Wall Solutions, provided retaining wall and construction supervision services for the wall in 2008 while the store was being built.

The suit alleges the wall was defectively constructed and failed, necessitating Wal-Mart to demolish it and rebuild it at a cost of more than $75,000. Wal-Mart is seeking monetary damages from the demolition and reconstruction of the wall. In a February 2009 letter from Millenia Wall Solutions that was attached to the suit, the company said it believed the retaining wall “should perform as expected” once a fence that was placed against a portion of the wall was removed.

The store at 550 Congressional Drive in northwestern Lawrence opened in April 2009.

A man who answered the phone Wednesday at a number listed for the Minneapolis-based company said the company had been out of business “for quite some time.”
