Sierra Club plans litigation against utility

The Sierra Club will have a news conference Tuesday to announce litigation against a Kansas electric utility.

The organization on Monday declined to say which utility, but the news conference will be in Lawrence, which is served by Westar Energy Inc.

The 11 a.m. news conference is being held in conjunction with the Sierra Club’s National Coal Day of Action, which will feature activities across the nation.

In February, the federal government filed a lawsuit against Westar alleging that the company violated the Clean Air Act by failing to install the best available pollution control equipment at its plant in St. Marys after it made major modifications to the plant.

Westar has denied it has violated the Clean Air Act and has asked a judge to dismiss the case.
