A Jefferson County man faces an attempted second-degree murder charge related to a Sunday evening domestic dispute, and his wife remains in the hospital in stable condition, Sheriff Jeff Herrig said Thursday.

Prosecutors have charged Thomas Cloyd, 47, with attempted second-degree murder, aggravated battery and interference with parental custody.

Herrig said officers were called to a disturbance Sunday evening at the family’s residence on 54th Street near Lake Dabinawa and southwest of McLouth. Herrig said the couple are married. County records list Cloyd as the owner of the property.

The sheriff said Cloyd fled the area with his three sons, and police in Haysville in Sedgwick County arrested him Monday morning without incident. Cloyd’s parents live in Haysville, Herrig said, and the three young boys were not harmed and are now safe with other family members.

Officers returned Cloyd to Oskaloosa, and he appeared before a Jefferson County judge Tuesday.

Herrig said because it was a domestic dispute his office would not release details about the alleged incident.

“It was a physical altercation at the house,” Herrig said.

He said that Cloyd’s wife suffered injuries and that she was still in a hospital Thursday morning in stable condition. Herrig said he would not release which hospital she was taken to.

Cloyd remains in the Jefferson County Jail on $100,000 bond related to Sunday’s incident.

A judge has appointed Atchison attorney John Kurth to represent Cloyd, whose next court appearance is scheduled for Tuesday. Kurth said that likely would be delayed because he has a scheduling conflict.

Kurth also declined comment on the case Thursday pending his reviewing of law enforcement reports.
