Federal judge rules Yellow House co-owner competent to stand trial

— During a brief hearing Monday afternoon, a federal judge declared Carrie Neighbors, an owner of the Yellow House Store in Lawrence, competent to stand trial in three cases she faces.

U.S. District Judge Carlos Murguia made the ruling after Neighbors had undergone a recent psychological examination. Murguia ordered the psychologist’s report remain sealed.

Neighbors and her husband, Guy Neighbors, face charges in three separate cases. In the main one, they are accused of selling stolen goods from their secondhand store, 1904 Mass., and face 19 charges of wire fraud, conspiracy and money laundering in the 2007 case.

In the other two pending cases, prosecutors accuse them of manufacturing marijuana and obstructing a theft investigation.

Guy and Carrie Neighbors have maintained their innocence and, until last year, they frequently used Internet blogs to criticize federal prosecutors and Lawrence police officers.

Prosecutors have repeatedly said many of the defendants’ allegations are false and are meant to intimidate witnesses.

In May, a federal magistrate judge revoked Guy Neighbors’ bond and ruled he posed a threat of “continued criminal defamation of government counsel and witnesses” for an April 22 e-mail he sent that accused prosecutors and police of corruption. Earlier, the couple had reached an agreement with the judge not to discuss the case publicly.

Federal prosecutors had asked for psychological examinations of both defendants earlier this year to determine whether the couple would be able to assist in their own defense.

During a hearing Tuesday morning, Murguia is scheduled to rule whether Guy Neighbors is competent to stand trial.

same here I may rant about the lpd but I am only talking about a specific few bad apples in the department. In General there are a lot of very good police officers that do good for the community.

So please don't misunderstand my rants.

Nope, I was just curious what his links were. I may question some of their practices from time to time and there is an officer or two that can get on one's last nerve but I do not hate or even dislike LPD in general. I find it very hard to be negative about them especially when I have to rely on them all to often. I wouldn't want their job or their pay and someone has to do it. Talk about a thankless job. They are damned if they do and damned if they don't.

The bottom line is they were caught with a bunch of stolen goods and are accused of fencing which seems to be a subject that was_freashpowder2 wants to ignore. There may be stupidity here but it isn't mine.

Headdoc, please post a link to show what stolen goods that factually have been found at the YH or the store. If you cant then you will see why the feds have not been able to take Guy or Carrie To trial.

Evidence, you kind of need it to back up allegation against someone in a trial setting. If you don't have it how are you supposed to ever have a trial ?

Also no one has even said anything about the Robert sample issue. Carrie & Guy Neighbors were charged with Federal Obstruction of justice because of the KU police investigating Robert Sample. Turns out they were charged with FEDERAL OBSTRUCTION OF JUSTICE in a Local county case that involved Robert Sample.

So how could Robert sample be charged in a local county case but yet Guy and Carrie Were charged with federal obstruction of Justice in a local county case. When the Law clearly states you can only be charged with federal obstruction of justice in a federal case, and Robert Samples Case was not Federal ?

head doc says....You may think that Ludwig is a stupid chump but he and his buddy took the smart route. To bad Guy and Carrie didn't do like wise. Instead of drawing a minimum sentence, maybe even just probation, they may get to spend the rest of their productive life span in prison. But as I know you will. Keep running your mouth and add a few more years to their sentence. It wont take the prosecutors two minutes to decide that your posting is being manipulate by Guy and or Carrie. Violating and continuing to violate court orders really isn't to bright but I am sure Guy has had a few months to think about that. Especially since the whole mental instability idea seems to have failed.

This statement and implications are exactly what the following articles are about....the Neighbors will not take a plea.....the feds are going way outside the law to punish them for this decision. These actions and threats are so common place that it is generally documented and specifically involved in the current supreme court case for federal prosecutor corruption.

Oh good lord. Come on pace, you are better than this. Was_freashpowder2 has been rambling on with the usual conspiracy crap while ignoring the facts and I have been gladly poking a stick at him. Personally I am sick of all this BS. This isn't a case of disagreeing with me or free speech. It has to do with violating court orders of which, was_freashpowder2 knows exactly what I am talking about and is a good part of the reason Guy's bond was revoked. As far as a review board, I have never had a problem with that. I rather like the idea of the watchers having watchers. I can not say if the case was miss handled or not.

You must really think people are ignorant. The cops and the Feds didn't just one day have a light bulb go on and decide to run to the Judge for a search warrant to go after Guy and Carrie.

actually yes they did and when the Lawrence D.A. told the Lawrence police cops they were crazy there was no proof the neighbors committed any crimes. The cops tried to make this federal by claiming the Neighbors made millions of dollars fencing stolen goods and didn't claim any of it on taxes. Please watch the videos the ljworld as done over the last 5 years on this story.

First the police claim Guy neighbors made 36 million dollars and then when the IRS got involved the IRS said no the Neighbors did not make 36 million dollars. Then the LPD changed their story to hundreds of thousands of dollars. Then 7 months later it changed to tens of thousands and now here we are and the amount is now around the $250 that the police are claiming.

Wow, now anyone who disagrees with headdoctor is accused with violating a court order not to criticizing the handling of this case, according to head doctor. The level of intimidation in any comment thread on this case is pretty sickening for people who believe in freedom of speech. We as a community should stand up to bullies, This community needs a citizens review board. ask for and take our responsibility for clear communication and standards of practice. Yes the police chief is against the community taking any responsibility for how his force functions, I wish he would see that it would strengthen the effectiveness and the safety of both the community and the police.

Convenient? Yes it was. For the cops. The Neighbors providing a whole house full of stolen goods and left a trail of dispersal records from Ebay, etc. Because of the circumstances, no one with a sound mind is going to buy the story that they didn't know they were selling hot merchandise.

so 2 convicted felons with priors plead guilty and take the deal which at this point is probation in return all the prosecutor asks is they claim Carrie and Guy were telling them to break the law.

How convenient......

think about it if ludwig and his partner in crime are such good witnesses. then why wait 2-3 more years before a trial ?

This case is a Gitmo style joke. Guilty or not . Am I correct that guy is incarcerated in colorado at this point for contempt ? These folks have been drug thru the mud , arrested a few times now , submitted to competency hearings , and all over charges that would normally be probationary offenses with no prior criminal history.

So now what? They drag it out for another 4 years? This case is a joke. I don't keep up with the federal court schedule but know of at least three cases that made the local news that has been completely resolved since the Yellow House case began. The Prosecutors in this case are pissed off about blogs because they are being shown to be fools. I can't remember the woman's name but she is obviously pretty thin skinned if blogs cause her to cry to the judge. I agree it would be a totally funny if the courts ran out of money and had to drop this case.

Yes this judge is the brother of the director (? not sure of title) of LaRaza - Janet Murgia who was also a former KU Executive under former chancellor Hemenway. Another brother is, or was, also a judge in the area.

It would be fairly amusing to me if the Neighbors get off on account of the idiots in the Kansas state legislature failing to fund the court system and a court shut down due to furloughs results in denying them their speedy trial.

I didn't read the whole opinion, but Judge Lungstrum only dismissed count 2, which was for using a controlled substance while in possession of firearms. . .obviously that charge violated the Speedy Trial Act. But he didn't "dismiss the charges with prejudice." He just dismissed one. (unless there's another opinion out there dismissing another one . . . ) Additionally, I have no idea what charges are currently pending against the Neighbors.

I don't have a vested interest in this case, other than I'm glad I am productively procrastinating. . .

Again, motions, like the one that you referenced, contribute to days not being counted against the prosecution as far as the right to a speedy trial is concerned. I merely mean to explain that even though some of these charges have been in limbo for a long time, the statutory 70 days probably isn't being violated b/c all the things you mentioned earlier (like the motion to dismiss) stop the speedy trial clock, so to speak, until they are resolved.

Funny, you feel this way about the Neighbors but not Mangino. Considering Mangino is without doubt guilty and the Neighbors are accused of guilt....

The mental incompetent argument is supposed to be used by the defense when they think they cant win in a trial.

Thank you for helping me study for my advanced criminal procedure final, despite my best attempts to procrastinate.

First, your right to a speedy trial is given in the 6th amendment and doesn't assert a time period. The federal rules of criminal procedure, however, do provide for the 70 day rule you reference. (just a technical point, not a big deal)

Second, the 70 day requirement only counts days which aren't in periods of exclusion. A period of exclusion exists when a delay results from proceedings concerning the defendant. Including things like physical/mental examinations, delays resulting from other charges, and pre-trial motions (from filing through resolution of the motion). There are ways to get exclusions, but these pretty much some up everything you listed. My guess is that the 70 day period likely hasn't even come close to being an issue yet b/c of everything that's gone on resulting from proceedings concerning the defendant(s).

And in other news the Neighbors done it to their selves. Probably scared to death that they are going to be doing some serious time. The Federal Court Docket is pretty fully scheduled all the time. Lawyer changes, hearing requests, mental evaluations, running their mouth when they shouldn't have, and other efforts of out right stupidity such as causing more investigation has been the primary delay. What could have been a speedy trial has been turned into a disaster. One of which will no doubt come back and bite Guy and Carrie much harder than they ever imagined.

It doesn't help their sympathy cause when they tried to spin their way out of this locally. A lot of the charges were dropped? Doesn't look that way to me. Now, not only do they face the bulk of the charges they get to face the wrath of those they tried to jam with all their yadda, yadda. The bottom line is don't do the crime if you can't do the time.

i'm very sorry to hear of the unfortunate events the Neighbors are involved in. No one knows who is guilty of what until the facts come out and i truly hope the best for them and their family. Briefly knowing their son i pray that they can get back to a normal family life someday. Good Luck!
