The Windsor, an assisted-living facility in Lawrence, is facing a $10,000 fine after state regulators reported residents suffering from various forms of neglect, including bed sores and improperly cared-for hands, and facing risks of falling.

The Kansas Department on Aging announced the fine – the maximum civil penalty allowed by law – Tuesday afternoon, following a ruling signed March 17 that came from a site survey conducted at The Windsor from Feb. 29 through March 7.

Regulators described problems at The Windsor, 3220 Peterson Road, as having “significantly and adversely affected the health, safety, nutrition or sanitation of the adult care residents of the facility.”

Among them:

¢ Failing to notify a resident’s physician about the resident’s combativeness with staff, including refusals to take medicine or to eat; failing to obtain psychiatric treatment for the resident to deal with those issues; failure to properly treat cuts to the head resulting from a fall; and failing to prevent the resident from suffering from bed sores and rapid weight loss.

¢ Failing to provide services to address a resident’s risk for falls.

¢ Failing to provide appropriate care and cleaning for a residents’ hands, which had been found clutching old, decaying food, and with nails that needed to be trimmed.

The center, licensed to have 44 residents, had 40 residents at the time of the survey, said Karen Sipes, a department spokeswoman.

The center is managed by Wichita-based Legend Senior Living LLC.

Matthew Thornton, a vice president for the company, said that a resurvey conducted March 26 found that The Windsor had corrected all of the problems and once again was in compliance with its license.

“We appreciate the department’s findings and their role in helping us to provide good service,” Thornton said. “And we’re diligent – when these things are notified or identified – to do all that we can, as quickly as we can, and that’s evidenced by the resurvey.”
