Ottawa ? A mistrial was declared Tuesday in the Franklin County trial of a Lawrence woman charged in a shooting conspiracy.

Franklin County District Judge Thomas Sachse declared the mistrial after it was determined that some recording evidence had not been turned in by the Ottawa Police Department. A new trial date of Dec. 3 was set for Kay F. Gaillard-Taylor.

Franklin County Attorney Heather Jones said the mistake was inadvertent. There were about 50 CDs and DVDs with recorded evidence on them and four or five of them didn’t get turned in, she said. Neither she nor the defense had been able to review them.

Gaillard-Taylor was one of four people charged in the December 2006 shooting in Ottawa of Michael Miller. Miller, a Lawrence man, was to testify the day after the shooting in a Douglas County court case in which he was the victim of an aggravated battery. Miller survived the shooting.
