Inmate who raised pain concerns executed

May 18, 2006

— A man convicted in the shooting deaths of a woman and her son nine years ago was executed Wednesday in Huntsville, hours after a court rejected his appeal that the drugs used in lethal injections cause excessive pain.

The Texas Court of Criminal Appeals had rejected an appeal from Jermaine Herron that claimed lethal injection was cruel and unusual punishment. A last-minute appeal to the U.S. Supreme Court was turned away too.

The Supreme Court is expected to rule this summer in a Florida case over the drugs used in lethal injections.
