A lawyer representing Lake View Manor on Friday asked to withdraw from a civil lawsuit that accuses the nursing home of abuse and neglect.

Pat Barnes, Topeka, said neither he nor his law firm had been paid for their services to date, and that Lake View Manor had retained another lawyer. Douglas County District Court Judge Michael Malone approved Barnes’ request. The case is scheduled for jury trial on Aug. 21.

In the lawsuit, Craig Vann, a son of former Lake View resident Mildred Vann, seeks more than $75,000 in damages. The suit asserts that nursing home workers in April 2003 dropped his mother during a bed transfer, breaking her right leg, ankle and foot.

Mildred Vann died in November 2004. She was 82.

Lake View, 3015 W. 31st St., closed last month after state and federal officials terminated the home’s Medicaid agreement because of persistent reports of poor care and failed inspections.

Lake View is owned by Charles K. Pomeroy and his parents, Charles P. and Lurene Pomeroy of Topeka.
